Privacy Policy for Data Collected by RacePartner/Forte Interactive’s Clients

Forte Interactive, Inc. (“Forte Interactive” or “we”) provides various services to nonprofits and endurance event entities (“Clients”), including endurance event registration, constituent relationship management (“CRM”) software, email marketing, fundraising software, content management systems (“CMS”), online marketing services and other related professional services. Forte Interactive does not provide or market its services directly to consumers or individuals.

Forte Interactive acts as a data processor on behalf of its Clients. In this capacity, Forte Interactive does not own or have independent rights to control the use of the Personal Data it processes on behalf of its Clients; it acts solely on their instructions. As an agent processing Personal Data under the direction of its Clients, Forte Interactive has no direct relationship with the individuals whose Personal Data it receives. For purposes of this Policy, we call such data “Customer / Constituent Data.”

Forte Interactive works with its Clients who are responsible for providing notice of data processing to their constituents/donors, including information concerning (1) the purposes for which Customer / Constituent Data is collected and used; (2) a contact person to whom inquiries or complaints may be directed; (3) the types of third parties to whom Customer / Constituent Data is disclosed; and (4) the choices and means that such individuals are offered for limiting use and disclosure of their Personal Data.

 

Terms Used in This Policy

“Customer / Constituent Data” means Personal Data or other data collected directly by Forte Interactive’s Clients from individuals who: 1) make purchases / donations or who may be interested in making purchases / donations to Clients or 2) provide their Personal Data to our Clients either through the use of the Forte Interactive software or by other means and the Client subsequently stores such Personal Data in the Forte Interactive software.

“Financial Data” means data containing credit card numbers, bank account information or account information for online payment or merchant systems.

“Personal Data” means any information relating to an identified or identifiable person (“Data Subject”); an identifiable person is one who can be identified, directly or indirectly, in particular by reference to an identification number or to one or more factors specific to his physical, physiological, mental, economic, cultural or social identity.

“Sensitive Personal Data” means personal data that reveals racial or ethnic origin, political opinions, religious or philosophical beliefs, trade-union membership, and/or concerning health or sex life.

 

U.S.-EU Safe Harbor Framework

Forte Interactive complies with the U.S.-EU Safe Harbor Framework and the U.S.-Swiss Safe Harbor Framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information from European Union member countries and Switzerland. Forte Interactive has certified that it adheres to the Safe Harbor Privacy Principles of notice, choice, onward transfer, security, data integrity, access, and enforcement.  To learn more about the Safe Harbor program, and to view Forte Interactive’s certification, please visit http://www.export.gov/safeharbor/

Please note that certain information, such as human resources/employee information and information collected from visitors to our websites, is subject to different Forte Interactive policies and agreements. How We Use Customer / Constituent Data Collected by Our Clients

As an agent acting under the direction of its Clients, in most cases Forte Interactive has no direct relationship with the individuals whose Customer / Constituent Data it may receive. Instead, Forte Interactive relies on its Clients to provide notice of data processing to individuals, including information concerning (1) the purposes for which Customer / Constituent Data is collected and used; (2) a contact person to whom inquiries or complaints may be directed; (3) the types of third parties to whom Customer / Constituent Data is disclosed; and (4) the choices and means that individuals are offered for limiting use and disclosure of their Customer / Constituent Data.

In addition, Forte Interactive follows its Clients’ instructions with respect to disclosure, processing, transfer and use (if any) of Customer / Constituent Data. Thus, the ways in which we process, share or otherwise handle Customer / Constituent Data, as well as the purposes for which we process such data, will depend on our agreements with our Clients.

 

Use of “Cookies” and Other Automated Tools

Our Clients’ websites may use cookies to enhance your experience while using their websites. Cookies are pieces of information that can be transferred by a website to computers browsing that website. Cookies are generally used for record-keeping and analytical purposes. Cookies can make Web surfing easier by performing certain functions such as saving passwords, personal preferences regarding use of a particular website and to make sure the same advertisement does not appear repeatedly. Many people consider the use of cookies to be an industry standard.

Choices about Disclosures of Personal Data

When we act as an agent for our Clients, we rely on them to inform their constituents and donors about the possibility of disclosures of Customer / Constituent Data to third parties or the processing of Customer / Constituent Data. Our Clients are legally required to offer individuals the choices of opting out of such disclosures and opting in to the processing of Sensitive Personal Data.

Data Integrity

As explained above, Forte Interactive only processes Customer / Constituent Data in a way that is compatible with and relevant to the purposes for which it was collected or authorized. In most cases, Forte Interactive’s Clients are responsible and best suited for implementing data integrity measures. Forte Interactive nevertheless takes reasonable steps to ensure that Customer / Constituent Data in its possession is accurate, complete, current and reliable for its intended use.

 

How to Access or Modify Personal Data Stored in our Database(s)

Forte Interactive usually has no direct relationship with the individuals who provide Customer / Constituent Data to its Clients. Thus, if you seek access, or is you wish to correct, amend, or delete your Personal Data, you should direct your request to the entity to which you originally provided it.

Nevertheless, if you believe that your Personal Data is stored in our database(s) or otherwise handled by us, and you wish to make corrections or deletions, send an email to support@racepartner.com. We will make efforts to honor such requests, except where there is a significant burden or expense associated with doing so or where others’ rights would be violated. We will respond to your access request within 30 days.

 

Security

Financial Data transmitted through Forte Interactive’s software is transmitted using SSL (Secure Socket Layer) encryption. SSL is a proven coding system that lets your browser automatically encrypt, or scramble, data before you send it to us. Unfortunately, however, no data transmission over the Internet or data storage is 100% secure. Since no data security measures are 100% foolproof, Forte Interactive cannot guarantee the security of data transmitted or stored via our software and systems.

When acting as an agent processing Customer / Constituent Data under the direction of its Clients, Forte Interactive may be subject to agreements with such Clients specifying the conditions under which Personal Data received from the EEA should be processed and kept secure.

 

Social Sharing & Email this Page Services

If a Forte Interactive Client elects to use certain functionality in the Forte Interactive software which permits the Client’s donors or constituents to inform their friends about the Forte Interactive Client website, the Forte Interactive software is programmed to ask for the friend’s name and email address. For any email address collected in this manner, Forte Interactive will automatically send the friend a one-time email inviting them to visit the Forte Interactive Client website. The Forte Interactive software stores this information for the sole purpose of sending this one-time email. Forte Interactive Clients that utilize the aforementioned software functionality are responsible for ensuring that the privacy policies they publish on the website pages which enable such functionality adequately address the aforementioned use.

 

Limitations

As set out in the Principles, our adherence to the Principles may be limited to the extent necessary to meet national security, public interest, or law enforcement requirements.

 

Enforcement

Forte Interactive uses a self-assessment approach to assure compliance with this Policy and periodically verifies that the policy is accurate, prominently displayed, completely implemented and accessible. We encourage interested persons to raise any concerns by contacting us (see contact information below). We will attempt to resolve any complaints and disputes regarding our uses and disclosures of Personal Data.

Any questions, comments or complaints about the data practices (including without limitation compliance with data privacy principles of notice, choice, onward transfer, access, security, data integrity, or enforcement) of a hosted online software customer, or partner for whom Forte Interactive processes data, should be addressed to that customer or partner.

 

Changes to this Policy

This Policy may be amended from time to time, consistent with the requirements of the Safe Harbor Principles. We will post any revised policy on this website and your use of these sites following notice of such change will be deemed acceptance of the revised Privacy Policy, which may include application of the new policy to information provided prior to the date of such change.

Overview

Forte Interactive, Inc. (“Forte Interactive” or “we”) provides various services to nonprofit entities and other related businesses (“Clients”), including constituent relationship management (“CRM”) software, email marketing and fundraising software, content management systems (“CMS”), online marketing services and other related professional services. Forte Interactive does not provide or market its services directly to consumers or individuals.

Registering with us allows you to take advantage of all of our unique offerings, including reports on critical developments affecting the world of philanthropy and nonprofits, articles, ideas and insights on use of mobile, digital and social technology to enhance fundraising, volunteerism, advocacy, direct mail and other constituent engagement activities, for nonprofits. The information can include, but is not limited to, technology and operational best practices, tips and strategies from your peers working at other nonprofits and industry and Forte Interactive experts, tips on how to get the most out of technology, and announcements of new Forte Interactive software releases, solutions and/or related services from Forte Interactive and our partners.

We have created this Privacy Policy (“Policy”) to explain why we collect particular information and how we protect it. The Policy applies to data we receive from: 1) the www.Forte Interactive.com website and 2) any other website offered by Forte Interactive, including those which Forte Interactive may later create, operate or acquire (collectively, the “Sites”). Terms Used in This Policy

“Client Data” means information that Forte Interactive collects or receives directly from its own business Clients via the Forte Interactive Sites, including data of prospective clients.

“Financial Data” means data containing credit card numbers, bank account information or account information for online payment systems such as Paypal or Amazon.

“Personal Data” means any information relating to an identified or identifiable natural person (“Data Subject”); an identifiable person is one who can be identified, directly or indirectly, in particular by reference to an identification number or to one or more factors specific to his physical, physiological, mental, economic, cultural or social identity.

“Website Data” means Personal and non-Personal Data collected or submitted on Forte Interactive’s Sites.

 


Personal Data Received from the EU/EEA

Forte Interactive handles Personal Data transferred from the European Economic Area (EEA) in accordance with the U.S.-EU Safe Harbor Principles (collectively, the “Principles”). Some of this data is collected via our Sites and some of it is received by Forte Interactive as a result of its provision of services to its Clients. This Policy covers how we handle data we receive via our Sites and directly from our Clients.

Data Not Covered by this Policy

Please note that certain information, such as human resources/employee information, is subject to different Forte Interactive policies and agreements. Likewise, certain information we receive from our Clients is subject to agreements between Forte Interactive (or a Forte Interactive affiliated company) and its Clients. When Forte Interactive is acting as an agent on behalf of its Clients, it must adhere to its contractual obligations in handling Personal Data from the EEA. Data We Collect From Visitors to Forte Interactive Sites and From Our Clients
Contact and Profile Information
Our online registration forms require users to provide contact information that may include name, email address, format preference (HTML vs. text), address, interests, and similar information. We use contact information listed on Forte Interactive registration forms to send information the Site visitor requests.

Forte Interactive is a business-to-business (B2B entity) and does not seek to obtain Personal Data about consumers. Nevertheless, if Forte Interactive receives Personal Data (which may be submitted by visitors to its Sites or through other means), it processes such data only for purposes specified in this Policy or for purposes otherwise authorized by the individual to whom the Personal Data relates.

Forte Interactive collects, uses and discloses Website Data for various purposes. For example:

· We require contact and other information to add registrants to our mailing lists and create registrant profiles.

· We collect contact information such as names, mailing addresses and email addresses, and Financial Data such as credit/debit card information and online payment service information (for example, PayPal) from our Clients or prospective clients. We may use such information internally or share such information with third parties (whom we hire to perform certain tasks) for various purposes such as:

o for marketing or promotional purposes – for example, to offer our products and services, or upgrades/updates to our products or services, or different products and services;

o to provide our products and services, for credit card authorization and verification, to bill for our products and services, to communicate with Clients concerning their accounts, and for other customer service, authorization, account history and billing purposes;

o to ask for participation in surveys;

o to provide news and newsletters, special offers, promotions and targeted advertising; or

o to better understand how Clients and others access and use our products and services, including our Sites and advertising, on an aggregated and individualized basis, for the purposes of improving our products and services, and to respond to Client desires and preferences.

· We may also collect demographic and profile data (e.g., age, gender and income level) to improve our marketing and promotional efforts, to statistically analyze Site usage, to improve our content and product offerings and/or to customize a Site’s content, layout, and services.

· We may share demographic, profile and/or transaction data with advertisers or other third parties, but on an aggregated basis.

o For example, we may share aggregate information regarding purchases and usage of our software products as necessary for the purpose of our making royalty or other payments to third parties or for analysis, marketing or other purposes.

· We may share Website and/or Client Data with third parties for the purpose of facilitating the marketing or delivery of (i) Forte Interactive products and services and/or (ii) any related third party services.

By visiting our Sites or submitting information to us, you consent to the uses and disclosures listed above.

Internet Protocol Address
IP addresses are collected from all computers that visit our Sites. An IP address is a number that is automatically assigned to your computer when you use the Internet. We use IP addresses to help diagnose problems with our server, administer our Sites, analyze trends, track Site visitors’ movements, gather broad demographic information for aggregate use in order for us to improve the Sites, and deliver customized, personalized content. IP addresses are not linked to Personal Data.

Information from Children
Our Sites are directed to adults and usage by children is not intended. We do not seek to collect Personal Data about children through our Sites. If a child submits Personal Data to us on one or more of our Sites, and we know that the individual submitting the information is a child, we delete such information.

Use of “Cookies”
Our Sites may use cookies to enhance your experience while using our Sites. Cookies are pieces of information that can be transferred by a website to computers browsing that website. Cookies are generally used for record-keeping and analytical purposes. Cookies can make Web surfing easier by performing certain functions such as saving passwords, saving personal preferences regarding use of a particular website and ensuring that the same advertisement does not appear repeatedly. If you access our Sites from the EU, you should be aware that the EU e-Privacy Directive was recently revised so that users of a website must now consent to some cookies being placed on their computers. The law is evolving in this area, and browser manufacturers are working on enhanced browser settings. In the meantime, Forte Interactive is exploring methods of obtaining consent to certain cookies, such as through pop-up notices and/or its Terms of Service.

 

Choice/Opt-Out

Forte Interactive provides its Clients and prospective clients with the opportunity to opt-out of receiving communications from us at any time. If we have contacted you via email and you no longer wish to receive promotional emails from us, you can click on the “Unsubscribe” link at the bottom of our emails and follow the instructions. Your email address will be promptly removed from our email marketing database. Please note that we may still use email addresses for non-marketing purposes such as customer service purposes.

Corrections/Updates

If you believe that your Personal Data is in our possession, you can always modify or delete it. To make any such changes, email us at support@racepartner.com. We will respond to your access request within 30 days.

We reserve the right to maintain information about individuals who have violated our Terms of Use or who have had their access to one or more of our Sites blocked.

 

Surveys

We may conduct occasional online surveys via our website or via an email newsletter. These surveys are entirely voluntary and recipients may easily decline to participate.

 

Other Websites

Our Sites may contain links to other websites. Please note that when you click on one of these links, you are visiting another website for which Forte Interactive has no responsibility. We encourage you to read the privacy policies on all such sites as their policies may be different than ours.
